Hire Rules
Rent a Car Requirements
For any rent of a vehicle, you must present a Valid Driver License, Valid Passport of Country of Residence, and major Credit Card too, for confirm de hire of a
vehicle.
Europcar Guatemala does not responsible for the rent of car cancel, with or with out reservation, if any of those documents are not presented or not
valid.
Deposit Required
The rent of a car must be supported with a major Credit Card accepted in Europcar Guatemala, with a Deposit on this Credit Card for the rent of a car based on the duration of the
hire.
The most accepted Credit Cards on Europcar Guatemala Establishment are VISA, MASTER CARD, DINNERS CLUB AND AMERICAN
EXPRESS.
Any Rent of a vehicle has to a deposit in the Credit Card, no matters if the rest of a car is a prepaid Voucher or if was made the reservation before of the
rent.
Gasoline Service
The gasoline of hire car is not included on rate. The vehicle is full of gasoline, the client have to return the car at the same
condition. If the car does not in the same condition of gasoline when it’s returned, it will be pay a refuel service charge. In this case, the customer has pay the gasoline value plus the refuel service charge established by Europcar Guatemala.
Terms and Conditions of
hire.
1.- Definitions and General Principles
The various notions to which these terms refer shall be construed in accordance to the Highway Code or laws of the Republic of Guatemala. The hire contract is made on a personal basis, and may not be transferred. “You”, the hirer, means the drivers and payers mentioned in the hire contract and those signing it, who are deemed hirers. “We”, The Company, means Europcar, or any franchisees, whose corporate name is mentioned in the hire contract. “The Vehicle”, means a passenger car or utility vehicle let to you for the duration agreed under the Hire Contract. “Damage”, shall mean any damage to the vehicle including glass damage, which shall include lenses, mirror and lights. “Theft” or the vehicle shall include vandalism, theft of accessories and attempted theft. “Guatemala”, refers only the territory in the Republic of Guatemala. This document is no permission to drive out of the country; he the Hirer must have a legal permission to leave the country.
2.- Pre-Conditions for Hire
You are required to give us, supporting evidence, all the essential information to draw up your hire contract and in particular your identity, address, the category and date of issuance of your driver licenses and the form of payment for you r hire. Ay driver must have for at least 12-month currently valid licenses, corresponding to the category of vehicle hired. He or she shall also be aged over 21 (The age required might be higher for certain categories of vehicle). You will be required to make, at the start of hire, a pre-payment in the foreseeable amount of the hire bill, plus the
deposit.
3.- The Vehicle
3.1.- The vehicle’s Conditions
A document describing the vehicle conditions is attached to your contract. You agree to put on it in writing, before departing the station, any apparent damage not described. If not, we shall deemed to have delivered a vehicle complying with the statement. We are unfortunately unable to accept claims relating to apparent damage not reported at the time of departure.
You must return the vehicle in the condition in which you received it. Any reconditioning costs caused by the hire’s misconduct shall be added to the cost of hire, subject to the terms of the insurance: indicated when renting the
vehicle.
3.2.- Use of the Vehicle
In accordance with the principle or personal penalties, you are responsible for the offences committed during the term of the hire. Accordingly, you are informed that your references may be notified to the police authorities on demand. You undertake to use the vehicle in a prudent and reasonable fashion, and in particular, with out being under the influences of alcohol, narcotics or any other substance liable to be detrimental to your driving ability, as laid out in the Highway Code or Laws of the Republic of Guatemala, and in accordance with its intended use, which, for a passanger vehicle, means mainly the carriage of persons on a gratuitous basis, and for a utility vehicle, mainly the carriage of goods. CAUTION: The damage waiver, subject to proof does not cover impacts on the top and bottom bodywork. In particular you may not use the rental
vehicle:
· For rehire
· For carrying passengers for hire of reward
· To carry a number of persons in excess of that mentioned on the vehicle´s registration certificate;
· To take part in rallies contests of trial, wherever located
· To give driving lessons
· To push or tow another vehicle
· On the roads unfit for motor vehicles, or the surface or condition of which involve risks for the tires or parts under the vehicle
· To commit an intentional offense
The goods and baggage carried in the vehicle, including their packaging and fastening shall not damage the vehicle of cause unreasonable risk for its occupants. When you park the vehicle, even for a short stop, you undertake to lock the vehicle and to use the alarm and/or anti-theft devices fitted to the vehicle. You should never leave the car unoccupied with the keys in the ignition. Failure return the keys shall render the theft waiver void. In the event of damage or theft, you must forward to the company as soon as possible the accident report or receipt of theft report issued by the authorities, together with the vehicle’s keys and documents. CAUTION: Article 2-3.2 list minimum obligations to be observed during your custody of the
vehicle.
3.3.- Maintenance – Mechanical Problems
During your hire and according to the mileage run, you will be required to perform customary inspections (oil leveling excess of 1000 kilometers, tire pressure, etc.) Accordance with reasonable and prudent use. The hirer shall remain alert to any sign from the warning lights on the vehicle’s dashboard and shall take any necessary protective action, such as an emergency stop. The vehicle is provided to you with five tires in a condition meeting the traffic – legislation requirements. In the event of damage to one of them otherwise than by ordinary wear and tear, latent defect or major force, you undertake to replace it immediately at your own expense with a tire of the same size, type, brand, and wear. In the event of mechanical breakdown or accident, you are provided with an assistance service, included in the price of the hire. If the millimeter has not run for a reason other than technical malfunction, the hirer shall pay for mileage on the basis of 100 kilometers per
day.
4.- Duration of the Hire
4.1.- Definition and Computation
The hirers agree to return the vehicle to the company on the date specified by the hire contract, under penalty of civil and criminal legal proceedings. A hire contract shall have a maximum duration of 30 days. If you wish to keep the vehicle beyond the duration specified in the
contract:
· You are required to visit the Company Europcar Departure agency as a priority, or otherwise, the Europcar agency specified by the departure agency (or, solely for renters who are al holders of a Europcar payment card, to the Europcar station that will be indicated to you, by your original check out station).
· And to pay the Supplementary fee and cost at each close to the hire
contract.
4.2.- End of the Hire
The hire shall end upon return the vehicle, its keys and document at the company, counter, to uniformed Europcar agent. In no event will you return the keys to person, present on the car parks and claiming to be Europcar Agents. In the event that the vehicle were to be returning without its keys, the cost of the replacement will be charged to the renter, as well as of bringing the vehicle back. The company shall bear no liability for property left in the vehicle at the end of the hire. Exceptions: If the vehicle is confiscated of seized, the hire contract may be terminated as of right as soon as the judicial authority or hirer informs the company. Any use of the vehicle detrimental to the company shall be cause for the latter to terminate the contract as of right. In the event of theft, the hire contract shall ed upo9n delivery to the company of the complaint lodged with the appropriate authorities by the hirer. In the event of accident, the hire contract sall end upon delivery to the company of the accident report duly completed by the hirer an any third party concerned having paid any damages
caused.
5.- Payment
Hirers shall be jointly liable for the cost of hire. The estimated cost of the hire and service is payable in advance. 1t includes: the hire fee, computed according to the prices in force at the time of the contract’s signature, any lees of costs for options accepted by the hirer and an additional deposit to cover any damages caused during the period of the Rental
Agreement.
For payments made by bankcard, only an authorization will be asked for at the time of hire. Upon return, the amount of the bill shall be charged automatically to the account corresponding to the card submitted, unless the hirer offers another means of payment accepted by he company, beyond 30 days, hire, a bill shall be issued, and shall be paid immediately, even if the hire continues. If the due date for payment stated on the bill is exceeded, the hirer shall be liable, after notice, for late-payment interest on the amount due, at the legal rate plus 50%. The hirer expressly agrees that failure to make a single payment when due or delinquency shall entail immediate maturity of all outstanding bills, and entitle the company to claim immediate return of vehicles currently
hired.
5.1.- Applicable Prices
The prices applicable to the hire, supplementary services, and optional waivers or insurance shall be those at the time of the contract’s signature, an based on the information you have provided (duration, return station, etc.). Any change of such information shall entail application of a substitute price, mentioned in the brochure for the agreed price. The vehicle is provided to you with a full tank. You shall return it in the same condition. If not, you will be charged for the missing fuel.
5.2.- Deposit
The amount of the deposit shall depend on the category of the vehicle hired, and on the supplementary waivers taken out, it is intended to cover the damage suffered by the hirer through damage of theft of the vehicle. Its amount is specified in the RENTAL´S GUIDE brochure and, at the time of hire on your contract, if the hirer has not taken out supplementary waivers (theft and / or
damage).
6.- Liability in the event of damage to the vehicle hired or theft.
You are responsible for the vehicle In your custody. Accordingly, in the event of theft of the vehicle or damage to it for which you are responsible, or in the absence of any liability of a Third Party, you shall indemnify the company for the damage actually suffered. (Cost of repairs, market value of the vehicle, immobilization costs, administrative costs, etc.). Upon the end of the hire, in the event of damage of theft, you shall be charged an amount equivalent to the non-waivable amount (see price brochure). If the amount of damage to the company exceeds that amount, you shall be billed for the
difference.
7.- Our Optional Contractual
Waivers.
7.1.- Damage and / or theft
You may take out cover for limited amount of liability (LDW mentioned or ticked on the contract and/or theft of the hired vehicle), in consideration of a flat-rate payment per day of hire. Some of our prices include these waivers. Even if you take this option you will be charged a fixed amount per incident, according to the category of vehicle, as specified in the prices and the contract at the time of hire. If the actual amount of damage to the company is less than the fixed amount, you will be charged the lower of the two. If you bear no responsibility whatsoever, and upon refund from the liable third party, this will be refunded to you in full.
7.2.- Invalidation of Waivers
Drivers not specified in the hire contract, for which, the hirer shall remain liable, are not entitled to the benefit of the collision damage of theft waivers for the vehicle. Failure to comply with any of the express terms of articles 2, 3-2, or 4-2 hereof shall cause the contractual waivers taken out to be voided. The hirer or hirers shall then be liable fo the full cost of claim in accordance with generally applicable law governing
liability.
8.- Insurance / Assistance
All our vehicles are covered by a third party liability, in accordance with the legislation in force. They are also covered by assistance. You may also take out optional driver, passenger and personal effects insurance. The conditions and limits of the obligatory or optional insurance, of the contractual covers, and those of the assistance contract are explained to the hirer at the moment of the car
rental.
9.- Agreement regarding evidence
The contract’s image shall be stored on a physically unalterable medium. The parties agree that this image shall have the legal validity of an original
document.
Reservations Rules
Reservations Terms
Any made reservation, shall have the name of the hirer, date ant time of the arrive, date and time of the devolution, and location for pick it up the car. The reservation have to made 48 hour before of the arrival and you have to leave an E-mail, for receive the confirmation number from Europcar Guatemala or a confirmation
vehicle.
The reservations have to made it by Categories, and are subject to change the automobile brand. Europcar Guatemala takes the compromise for made valid the reservation y keep the car category
reserved.
For the reservation is required the Credit Card Number just for identification, and no charges on it. The charges and deposits in the credit card will be made at time on rent of a car.
The customer can modify or cancel ate the reservation 24 hour before the rent of a vehicle and cancel ate no more than a 24 hours after. If don’t, and he does not made any modification or cancellation, in this period, Europcar Guatemala covers to you the amount of a day like a
penalization.
Insurances and Coverage
Every Vehicle from Europcar Guatemala, has an insurance, and the client has to paid a quote for it. The Third Party liability, is mandatory and can not decline this on the rent of a car. This insurance is included on the LDW and may be is included in the
rate.
The LDW Insurance, covers a Collision and Theft, and third party, and the client is responsible for the first damages like a
deductible.
Every category of vehicle has a different deductible, and is priced by The company of Insurance in Guatemala.
You can reduce the risk of the deductible at half with a extra charge for another insurance, (price at time of the rent of a car). This insurance is not include in any rate of vehicles. The price of the insurance and the coverage has to be asked at time of the rent of a car, and maybe change in every season of the year. This insurance is offered on period of rent of 5 days
minimum.
In case, the credit card of the costumer had a insurance coverage for hire car, He can decline the insurance for collision and theft. In this case, the insurance of Europcar Guatemala is nullify and the risk for the customer is Total, no Deductible, and had to pay al the damage on the car, property of Europcar Guatemala, with the maximum value of the vehicle hired. The Third Party insurance is mandatory and can not declined for the customer, and the price is established by the Insurance company and Europcar Guatemala.
The customer is responsible, in case decline the Collision and Theft insurance, to pay the total value of the vehicle hired from Europcar Guatemala. In case the customer takes those insurance, the client is responsible to pay just the amount for deductible of the vehicle
hired.
The Personal Assistance Insurance (PAI) is not included on the rate and its offered apart of the rent of a car. This insurance has a coverage of Q10,000.00 for the passenger of the vehicle hired, for medical assistance. The extension of the Personal Assistance (SPAI) is for Q10,000.00 for each passenger on the vehicle hired. This insurance is not included on the rent of a car and is a different insurance for the PAI, and has another price. Prices and coverage for this insurance at time of the rent of a car.
Use Restrictions
The vehicles of Europcar Guatemala can drive inside of the Guatemala territory. If you want to cross the borders of Guatemala, you must solicitate a special permit with a cost of $25.00 for drive in another country.
This is the Countries that you can drive with the special permit only: El Salvador and Honduras. For others countries you have to ask at time of the rent of a car for
information.
Europcar Guatemala do not extend permits for cross the borders with Mexico. That means the car can not drive in Mexico city. Europcar Guatemala is not responsible if in the schedule of the costumer, is included a trip for a Mexico City; the customer is advice that he can not cross the border to Mexico, and Europcar Guatemala no offered extend a special permit for drive the car of Europcar Guatemala in Mexico City.
Insurance coverage in another Country
The hirer is responsible to pay the damages of the car made it in the foreign country, as a deductible maximum. In case of change a car in other country, out of Guatemala, for damage, the customer is responsible to pay the gasoline, permits, hotel, food times, and others, for the Europcar
Representative.
Is accordingly that the Customer is responsible to pay the deductible or the damages for the vehicle of Europcar Guatemala, as no matter what was cause of the accident. Europcar Guatemala is not responsible for coverage to third part insurance in another country, this insurance in another country is not valid for the vehicle hired. In case, The customer was the responsible for the accident, he has to pay the damage to the third party and the damage for the vehicle hired.
Any accident outside for Guatemala City, the unique insurance valid is the Collision damage and is nullify the Theft and the Third Party
Insurance.
Rates
The rates on this page, is including the LDW, Free Miles, and 12% of a tax. The prices are guarantee with a reservation, and maybe can change depending the season of the year (High or Low). In case: The customer visit this web page without a reservation, the prices can change without advice, and the rate is not
guaranteed.
The prices for High and Low season maybe can change during the year and the unique form for guaranteed the rate is the
reservation.
